We refer to the previous announcements made by Celcom (Malaysia) Berhad (“Celcom”) [now a wholly owned subsidiary of Telekom Malaysia Berhad (“TM”)], on 17 October 2002, 22 October 2002, 24 December 2002 and 1 October 2003 as well as our previous announcements dated 10 March 2006 and 20 March 2006 in respect of the above suit commenced by Technology Resources Industries Berhad (“TRI”), a wholly owned subsidiary of Celcom which is in turn, a wholly owned subsidiary of TM.


On 24 December 2002, TRI had filed an application in the High Court of Kuala Lumpur for summary judgement in respect of that part of TRI’s claim seeking recovery of a sum of RM11,053,438.34 paid to the Defendants on 4 June 2002 as alleged bonus/incentive payments (“TRI’s Summary Judgement Application”).

The TRI Summary Judgement Application was dismissed by the Senior Assistant Registrar with costs, on 10 March 2006.

On 20 March 2006, TRI has filed an appeal to the Judge in Chambers against the abovesaid Senior Assistant Registrar’s decision.

We wish to announce that TRI, upon procuring advice from its solicitors, has on 22 May 2006 withdrawn the said appeal with no order as to costs, with a view to get the matter fixed for an early hearing.

TM will make announcements from time to time in respect of any material developments in this matter.
