LEGAL DISPUTE WITH DETEASIA HOLDINGS GmbH ("DeTe")

We refer to the previous announcements made on 17 November 2005 and 5 December 2005 with respect to a suit by Celcom (Malaysia) Berhad (‘Celcom’), a wholly owned subsidiary of Telekom Malaysia Berhad against DeTe in relation to the Award of the Arbitral Tribunal dated 2 August 2005 (‘the Award’) in International Court of Arbitration of the International Chamber of Commerce Case No 12615/MS instituted by DeTe against Celcom. Celcom is seeking inter alia a declaration that the Award is contrary to the public policy of Malaysia and is accordingly unenforceable in Malaysia within the meaning of Section 5(2) of the Convention on the Recognition and Enforcement of Foreign Arbitral Awards Act 1985.
We wish to announce that Celcom has today been served with a sealed copy of an application by DeTe to, inter alia, set aside the Originating Summons and service of the Originating Summons on DeTe in Germany. The said application is fixed for hearing on 23 May 2006.
The application is premised on the ground that the court has no jurisdiction to determine the subject matter of the Originating Summons.
