We refer to the previous announcements which we made on 16 January 2006, 23 January 2006, 3 February 2006 and 20 February 2006 in respect of separate proceedings instituted in England and Singapore by DeTe against Celcom (Malaysia) Berhad ("Celcom"), a wholly owned subsidiary of Telekom Malaysia Berhad in relation to the Award of the Arbitral Tribunal dated 2 August 2005 (“Award”) in International Court of Arbitration of the International Chamber of Commerce Case No 12615/MS instituted by DeTe against Celcom.


In respect of the Singapore proceedings, DeTe had, on 11 January 2006, obtained liberty to enforce the Award in Singapore ("Enforcement Order").

On 16 March 2006, a consent order was recorded between Celcom and DeTe ("the Consent Order") before the Singapore High Court. The principal terms of the Consent Order are that the Enforcement Order be deemed final and the present action be stayed. Celcom is also to pay the sum of SGD14,000 as costs to DeTe.

The Consent Order effectively brings an end to the Singapore proceedings.

By a letter dated 16 March 2006 from Celcom’s solicitors to DeTe’s solicitors, Celcom has stated that the Consent Order was entered into with full reservation of Celcom’s rights and payment of the sums referred to in the Consent Order was being made under protest and without prejudice to such proceedings as Celcom is currently bringing in Malaysia, and proceedings that Celcom may contemplate bringing in the future.
