Telekom Malaysia Berhad ("TM") wishes to announce that its wholly owned subsidiary, Celcom (Malaysia) Berhad (“Celcom”), had on 13th December 2005 been served (through its solicitors) with a sealed copy of the Writ of Summons, the Statement of Claim and the Amended Statement of Claim in respect of a suit filed against Celcom by (1) Tan Sri Abdul Rashid Bin Abdul Manaf (2) Danny Ng Siew L’Leong (3) Datuk Yaacob Bin Md. Amin (4) Ungku Safian Bin Ungku Abdullah and (5) Mohd Razi Bin Adam, the 1st to 5th Plaintiffs respectively, (“the Plaintiffs”) in the Kuala Lumpur High Court bearing Civil Suit No.S4-23-77-2005.


The said suit was filed by Messrs Christie Soosay Nathan & Associates on behalf of the Plaintiffs. The Plaintiffs’ claim are for alleged libel based on certain alleged press releases which the Plaintiffs allege were published in the New Straits Times, Utusan Malaysia, Harian Metro and Berita Harian.

The Plaintiffs are seeking, amongst others, damages for libel as follows: the 1st Plaintiff – RM500 million, the 2nd Plaintiff – RM200 million, the 3rd Plaintiff – RM100 million, the 4th Plaintiff - RM200 million and the 5th Plaintiff - RM10 million.

The Plaintiffs are also seeking aggravated and exemplary damages (which have not been quantified), a retraction of all allegedly defamatory press statements released by Celcom, an injunction restraining Celcom from further publishing any similar allegedly defamatory words, a public apology and costs.

Celcom is to enter an appearance, through its solicitors, within eight (8) days from date of service of the Writ of Summons.

Celcom is in the midst of taking legal advice from its solicitors with regards to the said suit and will instruct its solicitors to vigorously defend the same.
