Subject WRIT OF SUMMONS SERVED ON TELEKOM MALAYSIA BERHAD (TM)’S WHOLLY OWNED SUBSIDIARY, CELCOM (MALAYSIA) BERHAD

    CIVIL SUIT NO. S6 -23-74-2005
    TM wishes to announce that its wholly owned subsidiary, Celcom (Malaysia) Berhad (“Celcom”) had on 24th November 2005 been served with a sealed copy of the Writ of Summons and Statement of Claim for a suit filed by MCAT GEN Sdn Bhd (“MCAT”) in the Kuala Lumpur High Court bearing Civil Suit No. S6-23-74-2005.
    The said Writ of Summons and Statement of Claim was filed by Messrs Christie Soosay Nathan & Associates on behalf of MCAT. In its Statement of Claim, MCAT has pleaded a cause of action for libel against Celcom based on certain alleged press releases which appeared in the New Straits Times, Utusan Malaysia, Harian Metro and Berita Harian. MCAT is seeking, amongst others, damages for libel in the sum of RM1.0 billion, aggravated and exemplary damages, an injunction restraining Celcom from further publishing any similar defamatory words, a public apology and costs.
    Celcom is in the midst of taking legal advice from its solicitors on this matter. Celcom will enter an appearance, through its solicitors, within eight (8) days from date of service of the Writ of Summons and Statement of Claim and will instruct its solicitors to strenuously defend the suit and file counter claims.

(2) KUALA LUMPUR HIGH COURT (COMMERCIAL DIVISION)
SUIT NO. D-22 -1682-2005
    TM wishes to further announce that Celcom had also on 23rd November 2005 been served with an unsealed copy of a Writ of Summons and Statement of Claim for a suit filed by MCAT in the Kuala Lumpur High Court.
  • The said Writ of Summons and Statement of Claim was filed by Messrs Christie Soosay Nathan & Associates on behalf of MCAT. In its Statement of Claim, MCAT has pleaded a cause of action for breach of contract against Celcom based on an alleged Resellers Agreement. MCAT seeks, amongst others, specific performance of the alleged Resellers Agreement, damages in the sum of RM609,688,667.00, damages in lieu or in addition to specific performance, interests and costs. Celcom is in the midst of taking legal advice from its solicitors on this matter. Celcom upon being served with a duly sealed Writ of Summons will instruct its solicitors to enter an appearance to the suit and to strenuously defend the suit and file counter claims.
