TM wishes to inform that the Court of Appeal has on 7 September 2005 dismissed with cost, the application made by Mobikom on 15 August 2005 pursuant to Section 44 of the Court of Judicature Act 1964 to inter alia stay further proceedings in the event a Winding-up Petition has been presented.

Following the said decision, Mobikom will immediately file an application for a stay of the Winding-up proceedings in the High Court in which the Winding-up Petition was filed. As stated in TM’s announcement on 5 September 2005, the Winding-up Petition has been fixed for hearing on 21 October 2005.

Based on legal advice, Mobikom has a good legal basis for its application for a stay of the Winding-up Petition filed by Inmiss.

TM wishes to reiterate that the said application for a stay of proceedings and the service of the Winding-up Petition on Mobikom will not have any material financial and operational impact on TM.
