We refer to Telekom Malaysia Berhad’s (“TM”) announcements dated 4 April 2005 and 15 April 2005 on the Arbitration Award dated 31 March 2005 in respect of the arbitration proceedings by Inmiss Communication Sdn Bhd (“Inmiss”) against Mobikom Sdn Bhd (“Mobikom”) and the Notice of Demand dated 14 April 2005 pursuant to Section 218 of the Companies Act, 1965 (“S. 218”) issued and served by Inmiss on Mobikom respectively.
TM hereby wishes to announce that Mobikom through its solicitors has filed the following applications with the High Court in Kuala Lumpur:-
- Originating Motion to set aside the said Arbitration Award and Summons in Chambers for Stay of Execution of the said Arbitration Award; and
- Originating Summons for an injunction to restrain Inmiss from presenting any petition under S. 218 to wind-up Mobikom in respect of the sum claimed in the said Notice of Demand or the sum of the Arbitration Award pending the disposal of the hearings of the abovementioned applications in the High Court.
TM wishes to reiterate that the Mobikom’s applications to the High Court as abovementioned will not have any material financial and operational impact on TM. TM will make further announcement of any material development on the above matter from time to time.
