Telekom Malaysia Berhad (“TM”) wishes to announce that TM jointly with its wholly-owned subsidiary, Telekom Publications Sdn Bhd (“TPSB”) have instituted legal proceedings against BG Media Sdn Bhd (“BGM”) and BG Online Sdn Bhd (“BGO”) by way of a Writ of Summons and Statement of Claim on 10 August 2004. TM and TPSB have also filed an application on even date by way of Summons in Chamber dated 10 August 2004 and Affidavit in Support dated 6 August 2004.

TM and TPSB are seeking an injunction and damages from BGM and BGO for:-

(i) Infringement of TM’s and TPSB’s “YELLOW PAGES” trademark by BGM’s and BGOs’ use of the mark “YELLOW PAGES” in relation to their Super Pages telephone directory and their web-site, www.superpages.com.my; and

(ii) Passing Off of the BGM’s and BGOs’ Super Pages telephone directory and web-site as TM’s and TPSB’s Yellow Pages telephone directory and web-site by using the mark “YELLOW PAGES” and a “get-up” which is confusingly similar to the “get-up” for the Yellow Pages telephone directory as being in some way connected, associated or sponsored by TM and TPSB.

Potential Effects of the Action on TM

The legal action was instituted to protect TM's and TPSB's rights in respect of the "YELLOW PAGES" trademark. Based on TM’s and TPSB’s assessments and belief, the legal action would not give rise to a material adverse impact to the financial positions of TM and TPSB.

TM will announce further developments on the above matter as and when it becomes necessary.
