We refer to our previous announcement dated 27 August 2004 in respect of the above arbitration proceedings instituted by DeTe against Celcom (Malaysia) Berhad ("Celcom") a wholly owned subsidiary of Telekom Malaysia Berhad.


As previously announced, in a letter dated 24 August 2004 from the Secretariat of the ICC International Court of Arbitration, the Secretariat noted that DeTe had quantified its principal claim against Celcom as USD177,243,609 (amounting after currency conversion to RM673,525,715). However, as at that point, DeTe had not quantified its claim for interest.

Celcom has on 30 November 2004 received DeTe’s Post-Hearing Brief dated 29 November 2004 (“Claimant’s Brief”). In the Claimant’s Brief, DeTe has now quantified in part its claim for interest for the period 16 October 2002 to 27 June 2003 as USD16,252,139. Further, in its Claimant’s Brief, DeTe has also claimed that for the period from 28 June 2003 until full settlement, interest will accrue at the rate of 8% per annum on the sum of USD177,243,609.

Celcom has also filed its Post-Hearing Brief on 29 November 2004 and has refuted DeTe’s claims to damages and interest. The Parties will be presenting their oral submissions before the Tribunal in London on 7 and 8 January 2005.
