We refer to our announcement dated 9 January 2006 relating to the filing of Celcom’s application to strike out MCAT’s claim in these proceedings on the grounds that the Statement of Claim discloses no cause of action, is frivolous, vexatious and an abuse of process of the Court (“Striking Out Application”).


On 22 March 2007, having heard arguments from counsel for both parties and having perused the relevant cause papers, the Senior Assistant Registrar ordered that the Striking Out Application be dismissed with costs.

Subsequently, on the same day, Celcom filed its Notice of Appeal to the Judge in Chambers against the whole decision handed down by the Senior Assistant Registrar in dismissing the Striking Out Application.
